These Terms & Conditions govern your use of the Sioux Falls Quest website, products, and services, including our SMS program, operated by Media Quest LLC. By accessing or using our website or services, you agree to these Terms.

1. About Sioux Falls Quest

Sioux Falls Quest is a self-guided outdoor quest experience offered by Media Quest LLC. Our quests are designed for entertainment and are completed by participants in public spaces not owned, controlled, or supervised by Media Quest LLC.

2. Eligibility

You must be at least 18 years old to purchase a quest. By purchasing, you represent that you are at least 18 years old, or that you are a parent, legal guardian, or other authorized adult purchasing on behalf of a group that may include minors.

You may use our website and participate in our quests for personal, non-commercial purposes only. You agree not to:

We may use passwordless authentication, magic links, or similar access methods. You are responsible for maintaining the security of your email account and device. Access links are personal, limited-use, and may expire. Accounts and purchased access are non-transferable unless we expressly allow otherwise.

5. Purchases and Access

When you purchase a quest, you receive a limited, revocable, non-transferable license to access and use that quest for personal entertainment purposes only. We reserve the right to suspend or revoke access obtained through fraud, chargebacks, abuse, unauthorized sharing, or misuse.

By completing a purchase, you also confirm that you have read and agree to be bound by our separate Release of Liability, Assumption of Risk, and Waiver of Claims, which is incorporated by reference into these Terms.

6. Quest Completion and Badges

Digital badges or completion markers may be awarded upon verified completion. Badges are non-transferable, have no monetary value, and may be revoked if obtained through fraud or misuse.

Program Description

Sioux Falls Quest uses SMS for two specific purposes: (1) sending you a link to your purchased quest if you request it, and (2) delivering in-game experiences where you text us and we text you back the next clue during an active quest. We do not send recurring promotional or marketing messages via SMS.

How to Opt In

You opt in to SMS by providing your phone number and requesting your quest link, or by choosing to participate in an in-game SMS experience during your quest.

Message Frequency

Message frequency varies. You can expect to receive messages only when you request your product link or during your in-game experience.

Message & Data Rates

Message and data rates may apply. Check with your mobile carrier for details on your plan's messaging rates.

How to Opt Out

You can stop receiving SMS messages at any time by replying STOP to any message we send you. After texting STOP, you will receive a single confirmation message and no further messages will be sent. You may also opt out by emailing [email protected].

How to Get Help

For assistance with the SMS program, reply HELP to any message or contact us at [email protected]. Standard message and data rates apply to the HELP response.

Supported Carriers

Our SMS program is available on most major U.S. carriers. Carrier support is not guaranteed and may vary.

8. Important Safety Notice

Sioux Falls Quest is a self-guided activity conducted in public spaces. Participants are solely responsible for their own safety, decisions, supervision of minors, route choices, pace, and compliance with all laws, signs, barriers, closures, traffic controls, and property restrictions.

No clue, prompt, or game content should ever be interpreted as requiring:

Participants should stop moving before reading clues, typing answers, or otherwise using a phone or device whenever distraction could create risk.

9. Separate Release Required

Participation in any Sioux Falls Quest experience is subject to our separate Release of Liability, Assumption of Risk, and Waiver of Claims, which must be accepted before participation begins. That document governs all injury, risk, and liability matters related to physical participation.

All quest content, stories, clues, imagery, branding, text, designs, and related materials are owned by or licensed to Media Quest LLC and are protected by applicable intellectual property laws. Unauthorized use is prohibited.

11. Disclaimers

Our website, quests, and services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, error-free operation, route availability, weather conditions, cell service, public access, or the condition or safety of any public or private location appearing in or near a quest.

Because quests occur in public spaces not owned or controlled by Media Quest LLC, we do not inspect, maintain, or guarantee the condition of sidewalks, parks, bridges, streets, trails, landscaping, water features, lighting, or any other public or third-party property.

12. Limitation of Liability

To the fullest extent permitted by law, Media Quest LLC and its owners, officers, employees, contractors, agents, affiliates, successors, and assigns shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of the website, services, SMS program, or quest experiences.

To the fullest extent permitted by law, if Media Quest LLC is found liable on any claim arising out of or relating to your purchase or use of a quest, the aggregate liability shall not exceed the amount paid by you for the specific quest giving rise to the claim.

Nothing in these Terms is intended to waive liability where waiver is prohibited by applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Media Quest LLC and its owners, officers, employees, contractors, agents, affiliates, successors, and assigns from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to: your use of the website or services; your participation in any quest; your breach of these Terms; your violation of law or property restrictions; or injury, damage, or loss caused by you or by a minor or guest in your care.

14. Governing Law and Venue

These Terms are governed by the laws of the State of South Dakota, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms, the website, the SMS program, or any Sioux Falls Quest experience shall be brought exclusively in the state or federal courts located in or serving Minnehaha County, South Dakota, and you consent to the personal jurisdiction of those courts.

15. Severability

If any provision of these Terms is held invalid, illegal, or unenforceable, that provision shall be modified only to the minimum extent necessary to make it enforceable, and if modification is not possible, it shall be severed. The remaining provisions shall remain in full force and effect.

16. Changes to These Terms

We may update these Terms from time to time. The Effective Date at the top reflects the most recent revision. Continued use of our services after updated Terms are posted constitutes acceptance of the updated Terms, except where separate acceptance is required.
